Properties Owned search - England & Wales
This is a search made to determine the addresses of all registered properties owned by a person or company in England and Wales. The Index of Proprietor's Names is not a public register. We can search against names of Local Authorities, Companies, Government Departments, Banks and Building Societies, but we can only search against the names of individuals if one of the conditions mentioned below applies:
1) The applicant is either the owner or has the owner's written consent to search
2) The applicant holds a Power of Attorney in favour of the owner of the properties
3) The applicant is a trustee on behalf of the owner of the properties
4) The applicant has a Court Order authorising him to apply for the search
5) The applicant has obtained a Bankruptcy Order against the person owning the properties
In each of the cases above proof will be required. In the first case this can take the form of a letter signed by the owner. In the other cases a copy of the document referred to will be required.
A search of this Index will reveal registered land or charge(s) in which the owner appears, to the Chief Land Registrar, to have a sole or joint interest.
A copy of the Index will be supplied, listing the properties owned. There is an option on the application form to obtain copies of the Title Registers for each property revealed. The Land Registry recommend that professionals do not rely upon the list for any official purpose and suggest that actual copies of the Title Registers are obtained.
To proceed with the search it will be necessary to provide evidence that one of the above conditions is met It is also necessary to supply at least one of the addresses owned by the person searched against.
